For buying a new flat, I have went for an Agreement of Sale with a small builder. I paid 4L amount as agreement. While paying the complete "Owner Contribution Fund", I got to know there are lot of deviation from the approved. In the broucher it was mentioned 4 feet for one balcony and 3 feet for another balcony. During construction, I was suprised that one balcony is 2 feet and another is little less than 2 feet. I am not interested in buying the flat and gave stop payment for the final settlement for the chque which I gave.
I thought of having a safe exit with the builder and not to say that I m not interested with the building and decided to say I have financial constraint. When the builder called me regarding cheque return, I told him that I have financial constraint and could not go with the proceedings.
I am not interested in buying this flat, with the major deviation and not as per the design he gave in broucher. I would like to have your advice on withdrawing this agreement. Thanks in advance!
