Bride Suicide during waiting period of mutual divorce

Hello,

One of my friend is stuck in a rather awkward situation. Here is the jist of the matter. Any quick  help wil be greatful.

1. Marriage between them happened under force against the wish of the groom., Groom expressed his unwilingness due to certain reasons post engagement but bride and family forced them to get maried in the police station. writen statement were obtained form bride side stating how the marriage has happned and that no dowry has been taken. this was signed b y bride and her family

2.  Groom registered the mariage and did not live even a single minute with bride. the mariage was never consumated. the couple never lived together till this very moment in the same house or anywhere for that matter.

3. Groom and Bride lived separately for 1 1/2 years. Several attempts were made by family members to make them love together but in vain. After that groom applied for divorce in court stating al the allegations.

4. Two rounds of councelling happened and case was in favor of Groom since councellors adviced  bride to go for mutual and start new life instead of fighting this out in the court.

5. Further to that mutual divorce was applied in the court . By then 2 1/2 years had passed.  the waiting period was 6 months and divorce was due by the end of Oct 2010.

During the 4th month (september) of waiting period of mutual divorce the bride commited suicide at her own house. The brides family have got aggitated and have filed a complaint in the court saying that the groom and his family is responsible for this and filed some sort of dowry case against them. Police investogation yet to happen.  Groom and family in agonizing pain.

what are the chances of the follwing sections..498A, 113, 306 304B etc Please advice with your valuable help!!

bride is a doctor and groom is an engineer. both are about 29 yrs old. wishing and hoping the grooms does not become another victim of these dangerous dowry laws. please suggest a

All depends upon the evidence that come on record. However, the previous court proceedings initiated by the husband and its record thereof shall help him a lot in this case.

It’s seems that you are hiding something, you stated that Groom was not in favour of the marriage, and again you are telling that Groom is an Engineer and the Bride was a Doctor, and again you said there is a undertaking that no dowry have been taken, why that undertaking have made who signed or not that will come later but why this question has arrised,

They both were very much educated to fight against their unwanted wishes which forcefully imposed to them.

And again when there is a mutual divorce filed and they waited for the date, it means everybody knows that what is the reason of divorce, so how can bride family is made complaint against the groom on the ground of Dowry and all.

As Adv Archana stated that all the things are depend on the evidence.

So you should disclose your real story.

Yes i agree that the earlier petitions (1st petition filed by the Groom stating the allegations against Bride which is kept pending before court....2nd petition is the mutual divorce petition which was due on Oct 28) wil be very helpful for the Groom and family.

There is absolutely nothing to hide by the Groom. the reason dowry was got in written in the police station is because the Brides family used dowry threat as a weapion when the Groom called off the marriage. To avoid any further damage the Groom's family wanted them to agree in front of police and write in papers that they dint ask or take any dowry.

I agree with you that it is very difficult to believe that such educated people have failed in such a manner. but as far as i have heard and seen , the Bride waa a very adament person by character and wanted to make this happen under any cost. as a matter of fact, the groom was forced to get engaged under suicide threats. The 1st petetion also states this. Also, the Bride has attempted suicide twice before the last attempt which proved fatal.

The Bride and family made wrong calculation that things will become alright after marriage and chose all wrong ways to makre this hapen. their folks are a little aggressive while the Groom and his folks lead a very decent life in a decent locality. Groom is professionally very successful so far and works as a  Project Manager in an IT firm and is spoken high among his peers and friends.

Coming back to the case..the Bride and her family have been looking out for matrimonial proposals by regiatering in matrimony sites durign the mutual divorce waiting period. The Groom has decided to produce this as well as an evidence in front of the court. Will this be of help?

Moreover, the Groom and his family are well to do and dont have to to ask for Dowry or Jewels. The Brides family have brutally stated that the Groom asked for the Brides house property and since they dint agree to give they called off the marriage and that is why all this eventually hapened etc. Such a thing never existed..it is a story coked by the Brides side to take revenge on the Groom for their daughters death.

In fact even during the engagement the Groom's mother had given some jewels to the Bride to wear during the engagement function and that jewel is still with the Brides side even after mutual case was filed.

Shame on the parents of the bride. They have disowned their moral responsibilities in bringing up their daughter in good discipline and now wasting the societal/court time.

If and only if parents of the bride are responsible I would say we can strike off 498a totally from the books of law similar to Tada and Pota.
