Brother is not vacating my house

I bought a house on home loan and registered on my name. Since I stay in other city for job purpose,i let my brother stay in that house in good will. It's been 7 years,he not ready to vacate the house and asking for a share in the property for the same. All my family members are supporting him since he is eldest of family. How to make him vacate the house?

I am a central govt employee, so he is threatening me that he will file false cases against me so that it endangers my job? Is it possible. Please share your expertise opinion.Thanking in advance.

If it is your own house, owned  by a registered title document, you can issue a legal notice demanding him to vacate and deliver vacant possession.

You should not give in to the sentimental pressures put by your fmily members in this regard.

After that you can file a suit for ejectment to eject this unauthorised person from your house property and for possession.

As an employee, did you obtain permission from your higher authorities to purchase the house?  If you permit, then you need not worry as the property is yours.

Since house owned by you and it's on your name so you are absolute owner of house , your brother is staying in house with your permission, he is licencee and have no right to claim any share in it, issue notice to him and terminate license and ask him to vacate the house if notice is not complied with then file suit for recovery of possession and mesne profits for use and occupation.

He (your brother) is a licencee and you have terminated the licence to occupy your house, file a suit for possession and/or permanent and mandatory injunction through a local prudent lawyer.

1.file suit for possession against your brother in court..to get possession of your house.

2.lodge police complaint against your brother for threatening you to file false cases .
