Supreme Court judgment in AUGUST 2010 which held that a developer can only sell a flat and has no right to sell a parking space. The verdict also held that, once the occupation certificate is issued and the society formed, the developer ceases to have any title on the open space.
My question is:
does this rule apply to any car parking space sold before august 2010 or post august 2010 judgment..??? what if i have paid money to builder after OC has been issued after august 2010...can i claim refund from the builder/developer???
