Buyer is missing after sales deed

I have a flat in mumbai. I entered in to sales deed with a Buyer in March, 2012 with an agrrement to pay full amount in 45 days. During the time period, Buyer came and ask for Origional Documents required to be shown to Bank for Loan case. So I gave the documents to him with receipt on stamp paper.

Later on, buyer conveyed that he don't have money to  buy the flat and close the deal. At present he is not ready to cancle the sales deed and not even returning the origional flat documents.

Last one week, Buyer is missing from city. I am not able to contact him.

Kindly suggest the appropriate solution to this problem. Area inspector is not ready to entertain this issue as it is a civil matter.

This is Advocate Rohit Dalmia from Mumbai. First, Need to see the stamp paper on which the buyer had given in writing all the contents he has taken from you.

Kindly check out with the bank whether he had approached them for the loan or not? if yes, then why the loan was declined to him????

 

You have to send a notice to him through the advocate for cancellng the deal and recalling of the original documents. The action needs to be taken at the earliest before he commits any fraud.
