Buying flat in cooperative housing in wb

I am joint owner with my father of a flat in a cooperative housing society of west bengal housing development board housing complex. The flat is small and We wish to buy another in the same premises. Is it possible to buy it in my name? Other wise if it is bought in my wife's name I shall not be eligible for home loan. What is the alternative. Can I give power of attorney to my mother for the existing flat. With Regards Probal Kundu

my father took the property in slum 5 years back from whom he has owned was second owner, but now as per annexure first owner name is showing and room also said as apatra, what to do next we dont know

'Buyer Beware' applies to property deals.

It shall be appropriate to get proper legal opinion from a very able LOCAL senior counsel of unshakable repute and integrity specializing in revenue/property/civil/DRT matters and well versed with LOCAL applicable rules/laws and having successful track record…. and worth his/her salt , before signing or making payment.

This may cost some FEE but can defend long term interest and hard earned monies.

Then if the rules permit to buy another one then you can.

Your counsel can also appraise you of hazards of PoA, Gift, transfer, sale etc etc in name of relative(s) and also of LOCAL applicable rules.
