Can a honorary employee contest in the eleciton?

Sir

 

A retired employee, upon becoming Honorary member of an Union after retirement, can he contest in the Eleciton of the Union  for the Post of Branch President of that Unit?.  I have vented out my view that he can not contest, because he is only an honrary member and not a regular member.  But my another friend who is well verssed with the law, is of the very firm opinion  that  nowhere the law   restricts him to contest  for the post of Branch President or Branch Secretary.  What is the legal point of view on this?

Constitution says they can contest. But my question is with reference to the judgement by Hon. N.Kirubakaran of Tamil Nadu High Court (https://timesofindia.indiatimes.com/city/chennai/Ex-staff-cant-represent-union-HC/articleshow/24405993.cms). Your learned views on this.
