Can a real estate agent stand for a committee election in a co operative society

Here we need look into the provisions of Maharashtra Co operative Societies aamendment act, 2019. As per the 154B-23(1)(ii) Without prejudice to the other provisions of this Act or the rules made thereunder, in relation to the disqualification of being a Member of the Committee, no person shall be eligible to be appointed, nominated, elected, co-opted for being a Member of Committee, if he carries on business of letting, subletting and selling of flats in the housing society of which he is a Member. So basically, if the person who is willing to appear for elections in actively involved into letting, subletting and selling of flats of that particular husing society then he will not be allowed to contest for the elections of housing society members. But here, as the real estate consultant was not engaged into selling flats or letting or subletting of any flats available in that society and he was just a mere employee of the builder property, so he will not be barred from enjoying his constitutional right of appearing for housing committee member's elections.
