Can Adhoc Committee collect society maintenance charges

As the word itself define the meaning of Adhoc Committee which means Committee formed for a specific task or objective, and dissolved after the completion of the task or achievement of the objective

In our commerical complex we members supported to form an Adhoc Committee to form the society in 2007 , but since then the Adhoc Committee did not take any initiative to form the society not even an application being made to Registrar of  Society . Now its almost 4.5 yrs but the Adhoc Committee is doing all its practise in name of Society, they are forcing ot pay the monthly society maintenance charges . Wherein 50% members are not paying as there is no transperancy in their operation , they have told that first form the society & then do all this work as  there is no meeting called in last 4 yrs , huge civil construction activities are being carried out without any approval ,without any discussion , without any meeting, without any concern . Nor any permission is taken . If any objection is raised it has no value as the same is not attended.

Have informed the Registrar of  Society on same hope to see some action through them.

 

Can the Adhoc Committee charge monthly maintenance charges from the shop/office owners.

 

Pl advice me on same.

Sir,

Yesterday we had a meeting with the officer of the Registrar of Society-CBD-Belapur , wherein they said that Adhoc Committee period is only for 1 year , also the objective of Adhoc Committee was to form the society. Adhco Committee is not a legal body. Also they cannot work for 4.5 yr in name of Adhoc Committee, huge huge transaction is going on without the knowledge of the members.

The officer told us not to pay the Adhoc Committee the charges , they said they will issue a legal notice to this Adhoc Committee as today there is 100% occupancy , but still the society is not formed since 2007 also handing over all the necessary documents & supporting papers & including payments for same.

Still there is no single initiative towards the formation of the society , not even application has been made to the registrar of the society.

 

Pl guide us on same for a clearer understanding.

Our commercial complex recvs apprx 4-5 lac rs which is 50% of the toatl rent from telecom tower & the rest 50% of rent is received by the builder ,earlier the Adhoc Committee never charged any maintenance charge from the office bearers .

In name of society registered by A, B or C or a Trust one can swallow  5 Lac crores of treasure trove in Swami Padmanavan Temple , TTD , Lalbag ke Raja etc etc. Yours is only 4-5 lacs . Just forget it man. This is the worst piece of Act to benefit the GOONDAS in any form. We need one more ANNA HAZARE to fight this critical disease of the society.

Yes, Adhoc committe can collect maintenance charges from owners.
