being pressurised from mother in law. wife went away to her mother 's house. thereafter husband made more than 10 attempts, often and often to convince her and bring back to his life. but she failed. therefore he choose to file resti of conju rights application before fam court. even apart from that she dint respond so ex parte was passed. now husband marriages other girl. now first wife have come up with application to set aside ex parte orders and filing condonation of delay.
I wanted to know the strength and stand of the case from the part of wife. and I will greatfull if I get supportive case laws. and importantly does family' court has power to pass ex parte ?
