Can criminal offence be lodged against a family member who avoids distributing property amongst legal heirs.our deceased grandpa left landed property in da native place and rented room in Mumbai city.my grandpa has 4 children 2 sons and 2 daughters .all of dem are between da age group of 67 to 80.one of da elder son is avoiding property distribution of both da properties frm past 7 years. He threatens and abuses his siblings over property issues.being da elder son he has original documents wid him although the rent receipt stands in da name of my deceased grandpa.now building in which da rented room is going for redevelopment. He wants da agreement to be on his name and oder siblings want to surrender it so if he keeps on avoiding da issue using abusive language can we go for criminal action against and will we get our share through DAT what is solution besides da elder brother who is avoiding is an advocate
