Can dowry/dv be filed after mcd petition is filed?

Dear Seniors,

Let me inform you that my Ex-wife and i have filed MCD last week and the 1st hearing also got over.

Lately there has been few heated mail conversations between us in the last 3 days, now she is intimidating me saying "Be happy that i dint file any case against u or asked for any compensations"

All i wanted to know is that are there any chances of she changing her mind doing the following things -

- Ask for compensation

- file a Dowry / DV 

- cancel the petition

Please let me know if should keep quite till the 2nd hearing, as her family is trying to make an issue so i show my contempt.

Please do not feel bad about this reply. It looks like you are out of NIMHANS and so is your wife. Going through MCD and exchanging loveletters that too heated one's via MAIL??? You both are definitely a mental case. Acts like these are surely going to put you in trouble if not her. Secondly, there is a fair chance while there is cooling off period, your lovely wife can file a case under 498a / DV or both, it holds good before eyes of law or not is totally a different matter and take.  Be prepared to face such cases if filed.  And it would be my advice to you that you cut off all communication with your wife.  Aurat log paagal hoti he, kab kya karde pata nahi chalta.  SO beware.

Thanks for your reply, i have seen your earlier replies to other posts also im not offended at as i know its your style of putting things across.

Anyway now i certainly understand what has to be done and what not as per ur advice.

Well advised by helping hand , immediately stop communicating with your wife , you will get divorce only after making patience .

Its highly dangerous to communicate with wife or her relatives when the matter is already in court.


Here in the forum people come telling, wife filed DV case, do you know how much does it cost to file a DV case?  hardly 40 to 50 Rupees.


40 rupees for typing and printout, 10 rupees stamp thats all and to come out of these kind of cases it takes 5-6 years, just imagine how mch energy the person would have lost in these 5-6 years , so much tension, paying fees to advocate, no patience and peace of mind at home, so mch one has to go through.


I just wish that in heated argument you have not used any unparliamentary words towards your wife or her parents or her relatives, just a 2 page green sheet can change your life in total.


So please do not talk to your wife in any form, email, letters, sms, calls, and remember even if they want to talk to you, please ensure that there is someone 3rd party there with you when she is talking in person, [just in case if she wants to meet you], as until you come out of this divorce case succcessfully there is always a chance of woman turning crooked.

She cannot file DV case if you have been separated for more than one year. Technically, of course, she can file anything she wants but it will not be maintainable. Dowry cases, I am not sure about the limitation act.  That said, the advice given to you to stay away from any communication at this time is a sound one.

I certainly agree with you and other members in this forum who have faced worst situations.

Well let me tell you that i was just firm in replying to her mails and i ve not used any such unparliamentary words.

Now that i've realised the seriousness of this i will never make this mistake again.
