Both me and my wife filed divorce separately. Wife filed it on ground of cruelty and desertion. I have filed my objection against her divorce petition and also filed a counter claim for divorce on the ground of desertion and irretrievable breakdown of marriage. In her written statement my wife objected to my allegation of desertion but admitted that no reconciliation is possible between us. Earlier the reconciliation attempted by court also failed. We are staying separately for more than 3 years now.
I'm looking for a quick divorce now. My understanding is since we both are staying separately for 3 years and both have indicated that reconciliation is not possible , I have sufficient ground to get divorce becos of irretrievable breakdown of marriage and I don't need to lead evidence to get divorce. However, as per my lawyer , we both need to provide evidence at the trial stage. Currently the divorce case is adjourned as sec 24 hearing is going on.
Can any expert throw light on this?
