Can i sell my 1/3rd share in property

Hi,

My dad made a gift deed of his house to us 3 sons and he is no more. Now my younger brother and myself want to sell our share in the property to a third person since my elder brother is unwilling to sell, nor is he willing to go for partition. Is it possible for my younger brother and myself to sell our stake in the property without any legal hassles? Please advice

If the house property can be divided in three parts you can.Nobody will purchase undivided share in house property if he cannot take actual possession.

If u are interested to go ahead with ur proposal to sell  ur respective shares, u may have to first get the partition of the property by mutual  consent,  in which case u should execute the partition deed and register it with Sub Registrar of Assurances with proper stamp duty, and thereafter sell ur shares. In case ur third brother is not cooperating for partition u will have to file suit or partition.
