Can I sue the Consultant

Sirs, I have paid an amount of Rs.25000 towards advance payment to an Immigration Consultant for Immigration to Hong Kong. The Consultant said the remaining 25000 has to be paid after getting the visa only. If I did not get the visa the amount will be refunded because to get the visa I have to visit the consulate in Hong Kong. But the refund is subject to some conditions. If the visa is denied because of fake documents, late submission etc the amount will not be refunded. The Hong Kong Immigration authorities have sent me a lette dated 04.11.2013 asking for submission of documents by 13.11.2014. But that letter reached me only on 13.11.2014 leaving me no time to send the documents. I immediately mailed about this to the Consultant and they advised me to send a mail requesting for extension of submission date. I did so but there is no reply. I send the documents on 22.11.2014 and they reached Hong Kong on 27.11.2014. The Immigration authorities Hong Kong send a letter dated 28.11.2014 that my application is cancelled due to late submission. I again contacted the Consultant about this and my case officer promised me she will speak to the authorities in Hong Kong. She later informed me that they are going for cross checking my application, if found I will be intimated through a letter. Even after 6 months there is no letter. I decided to withdraw and asked for refund. Until before visiting to their office in Hyderabad they talked positively but after visiting they suddenly changed thir voice and told me that you are not entitled for refund as you submitted the documents late. They agreeing that fault is not mine but they can not do anything because it is the decision of Govt. of Hong Kong. If there is no fault from my side then why you are not refunding? I asked to my Consultant. They are avoiding this question. My question is can I sue the Consultant for refund of the deposited amount legally? or there any other way of getting back the amount? You may show all docs on record to your lawyer and your lawyer may opine that you may notice both.
