Can my divorced friend be reinstated in govt teaching job?

my friend is around 45 yrs old.when she was 32 yrs. old she was appointed as a TGT(Maths) teacher in delhi govt. school.


three yrs. later she got married to a divorced navy doctor who was posted in chennai.

so she resigned from her govt job to join her husband in chennai.she was still not confirmed as permanent when she resigned although she had completed 3.5 yrs. of service.


now this year she got divorced and returned to her parents in delhi.


can the same delhi govt. take her back her in her teaching job?please suggest a way.she had only 3.5 yrs of working experience.

Since she was not confirmed employee, question of giving resignation officially does not constitute cession of service. She can plead for reinstatement  and join at the option of organization (in continuation ) or afresh.

will you please let me know under what legal provision she can apply for continuation,and how??

 

in case she applies fresh,will her age(45-46 yrs) not be a barrier?in govt teaching job,there is an age limit also.she has crossed that limit ...

Do not look for legal provisions. Just approach the school and try. Everything in this world is not done through courts.

Not able to agree.

 

There is no such provision to allow such re-joining. SUch re-joining will be illegal.

 

A resigned employee temporary or permanent has no right to rejoin unless the resignation is submitted by permanent employee to take up another Govt job and he/she is not confirmed in the said job.

 

In this case resignation was due to personal reasons.  No hope case.

 

She can apply a-fresh if age permits.
