Can police confisicate the items mentioned in the fir

Hello Team,

Sorry guys i am in deep sh*t and need help. I have 498A registered aginst me and my famliy. They arrested my family and now they are on bail out.

 

 Today we got a phone call from the police saying that they will come and confisicate all the items that my wife has mentioned in the FIR filed against me. Can they do that ?

 

what should we do ?

 

Please please help.

Where do you stay i mean which state.as far as i know that as per new supreme court law police can not arrest without a warrant that to after all investigations and chart sheet is prepared.

How come they arrested you and now confiscating all items.

They did not do this in my case yet.

Hello Rahul,

 

 I am at the moment in UK . I have not been arrested as I was not in india at the time. But what police is doing is telling us that they will come on Saturday and take all the items that is mentioned in the FIR filed by my wife .

 

I live in Maharashtra state Mumbai. Can you please advice on this as i am very desparate.My lawyer does not give me any answer and says that he will talk to police. But can police come to your house and take away the things that have been mentioned in the FIR  by her sid eof family.

 

What should we do ?

What are my options,?>


I am in need, please please help me. I will be obliged mate.

Rahul, which supreme court law are you talking about? Can you tell me Pls? If this is true, then why are people still taking AB?

Rakesh, As far as I know police can arrest you after the fir is filed. And they do have the power to confiscate anything that is relevant to the investigation. The new supreme court law that rahul is talking about, I don't have any idea, maybe it has just come out, he can explain better..

Earlier police used to arrest on fir immediately but now they investigate first and get chart sheet prepared then get the warrent and arrest before that people can get AB.

After FIR the police now needs the permission of DCP in some states before arrest. They can arrest before charge sheet and during investigation.. @ rahul
