Can RCR be filed by giving GPA to my Father

 

Hello Everyone,

I wanted to enquire if it’s possible to file a RCR case before a magistrate if I can execute a general power of attorney to my father. I am actually outside India on an assignment and my wife has gone back and wants to file a 498a against me and my lawyer is suggesting me that I come to India and file the RCR petition before the magistrate. As it seems it’s a necessary and is a procedure. My in-laws have called up my lawyer and threatened that they will file a 498a case against me. 

Please help me ..I ma concerned that if I go to India they may actually take my passport away, so I don't want to go.

Pls advice.

if u can stay indefinitely dont cum to india. start livin relatioship and contact a honest and expert lawyer to save ur parents from arrest under 498a.

NO RCR REQUIRED TO ESCAPE 498A TRAGEDY,  FIRST GO FOR ANTICIPATORY BAIL OF PARENTS.

RCR is a restitution of conjugal rights which only be filed before the district court or family court or sub-judge court as tje case may be.  You can give GPA to your father to file the case.  Anyhow you have to come to india to give evidence.  For abundant caution give a detailed complaint before the concerned superintendent of police that there will be a false complaint may be lodged by you wife in the jurisdiction wife resides.
