Can tenants one successor can fight the eviction case alone

Dear SIr,

My father is fighting a civil suit to evict our notorious tenant. The Tenant has died,One of the 6 successor wants to continue the fight, on his own capacitiy, without any NOC or any authorisation from other successors.  Can he do so ?

If he does so, and law has such provision, how can we restirct other successor from fighting the case when the first successor's  case is ended.

Whether the successor tenant was staying with the original tenant at

the tme of demise of the original tenant . if he has sufficient documentale evidenc then

he could not evicted.

Also check whether he has any accomdation in the city ownership or rented then he cannot

claim tenancy right

Yes he can, generally the court will ask you to take process on all the legal heirs of tenant to implead them, if they are not attending the court, proceed expartie against them, and proceed against one who is attending..
