N.K.Assumi (Advocate)     06 November 2012

Can this period as govt servant be counted as advocate?

Adocate on the roll of Bar Council of the State for two years, joined in the regular cadre of Prosecutor, and served for 20 years and resigned and continued his practise as an Advocate. Whether the period of 20 years in the regular cadre as prosecutor can be counted as an Advocate and designate him asenior Advocate.

Yes his period of advocateship will be counted from the date of his enrollment. Please see Section 24(9) of CrPC which clearly specify that during his appointmnet as an prosecutor he shall be deemed to be in practice as an advocate.
