Case file

Dear Friends,

I wanted to file Appeal in High Court in divorce case.

I wanted to know whether can I get Certified copy of whole Case File including Docket of the Case File.

Because I wanted to show High Court about each and everything happened in the Case.

I also wanted to know can I request High Court to Order Lower Court to provide the whole Case File.

A first appeal is a continuation of suit, and all aspects of the case are deal with in an appeal. Once your appeal is admitted the entire trial court automatically goes to the appellate judge, this is because the appellate court doesnt take fresh evidence (unless in an exceptional case) and hence trial court record is imperative to be seen.

Good Afternoon.

 

Sir that means first I should file appeal with Decree and Order in High Court.

Then if appeal admitted, then The High Court will Order Case file from Lower Court or do I need to get Certified copies or I will get the Order copy from High Court to get the Case file from Lower Court?
