Dear friends,
In one summary suit case we have taken a stand as defedent that Director ( plentif) is not authorised to file civil suit against us,because no proper resoulation has passed and submitted to court while filing civil suit against us.on just one certificate mentioning details of director /applicant (plentif )has file civil suit against us.
we have made application to dismiss the suit on the above basis.
please give some caselaws on the above matter if any -will be supporting to us.
