CASE STUDY- Harris v/s Nickerson

Hello,

Harris v Nickerson is an English law case dealing with formation of a contract.  The issue under consideration was whether the advertisement provided by the defendant is to be considered as a legally binding offer for sale which had been accepted by the claimant, whether it forms a complete contract. 

The court held that the advertisement was merely a declaration to inform potential purchasers that the sale was taking place. It cannot be considered as an offer and cannot be guaranteed that the objects mentioned in the advertisement be put for sale. Hence, it did not legally bind the defendant to auction the items mentioned in the advertisement. Thereby, dismissing the claimant's case.
