The case is regarding pay fixation. The case was initially filed by Asst Accounts Officers of Defence Accounts Dept. in Allahabad at CAT and got a favourable reasoned order. The CAT order was implemented by Union of India (UoI). However, a writ petition was filed in Allahabad HC by UoI which is at present pending.
Now, keeping in view of the CAT order, similarly placed officers/applicants in different parts of the country viz. Kolkata, Guwhati, New Delhi, Hyderabad, Patna got favourable judgements in CAT as well as HC. However, except Patna HC none of the HC went independently through the merit of the case. The favourable order has been implemented by UoI in Kolkata, Guwhati, New Delhi & Hyderabad. However, just before the Patna HC order, CAT Chennai full bench had given a diverse order against the applicants.
In the aforesaid a scenario, UoI has filed a SLP Civil CC in SC against the order of Hyderabad HC and the case has been admitted by SC after hearing. Later the SLP Civill CC against Guwahati HC order (Guwhati respondents was not aware & did not appoint any counsel)was tagged with the Hyderabad SLP.
Now SLP Civil CC against Kolkata HC order has been filed in SC by the UoI. What are the chances of getting a dismissal at admission stage by the Kolkata respondents???
