Change in property card of a trust property

We have property in Mumbai which is governed by a Trust. The current trustee are my grandfather (who at the age of 80 went missing 20 years ago) and my grandfather's brother who is no more. How to get the name on the property card changed to the legal heirs of my grandfather and his brother.

1. Declare the trustee legally dead, as per law person missing for more than 7 years can be presumed dead. obtain a presumption death certificate from a court.

2. File a civil suit in a competent court to declare your grand father legally deceased. You will need evidence such as police missing report, News paper advertisement and affidavit.

3. Check the trust deed, current trustee or successor, verify Property ownership and various other formalities. Hire a competent local lawyer who will help and guide you regarding all other formalities.

The trust deed is the guidance for all such eventualities.

If the trust deed states  or provides replcement on such events, you may follow them.

How is the trust functioning for the past 20 years or more without the trustees?

To change your name on a property card in Mumbai, you can access the Property Card Information System, visit the District Collector Office, or visit https://prcmumbai.nic.in. Refer to the Maharashtra Bhumi Abhilekh for property card details.

However you can take the assistance of a local lawyer either from this forum or outside

The trust deed shall be verified for details of the property, how it was acquired, who the trustees are, and the terms and conditions of the trust deed to form an opinion.
