Charges under ipc 420,406

I have been charged under the ipc 420,406. its been 3 years the case is under hearing in court and the chargesheet is filed. The convicted people along with me are not being present in all hearings and due to which the case is not on  track. moreover the complainant is also not appearing even after three summons.

My question is how do i get this case solved and prove myself not guilty. I have futhur carrer plans for january 2013 to go and settle abroad. my passport is being impounded in the court, is there any hope to get the passport from the court when the case is under trial?

1. I am not able to make out at what stage the case is, at present ? Is it for evidence of informant ? If he is evading. Warrants can be issued against him.

2. The Court can give you liberty to travel by releasing your passport, it is the court's discretion, however that depends on the overall tenor & gravity of the case.
