Myself Farooq, I was staying on house lease for 3.5 lac, and owner gave me 50k cash and gave post dated cheque worth 3lac. I trusted him and vacated his house, I called him just to confirm that if I can present the cheque to bank and he used to some reason not to present it. On presenting the cheque it got bounced with insufficient fund, and informed the owner but still he didn't give any dates and it got bounced for 2nd time with gap of 1 month. Finally I filled case in civil court bangalore.
It has been 6 years, and till now the case is still open. During first session accused agreed that he had to pay money but in subsequent hearings he never appeared.
On this court had issued NBW two times but nothing happened, reason was accused was not at home.
Accused wife is lawyer and because of her police is not daring to arrest him, she always says he is not at home though his car is parked outside.
Please suggest what can be done on this?
