Cheque bounce case

Hello sir,

I have filed two cheque bounce case against the accused for the cheque amount of 5 lakh each. Totally of 10 lakh.

The first hearing of the cases were on 15-5-2024 and 02-05-2024. It has almost crossed 10 months already. So may I know how long does it takes for the judgment if both the complainant and accused are present.

In the last questioning to the accused, The accused have answered that he didn't get the money as a debt from me. He was lying that he received the money for my marriage expenses. As he was the one who who managed the financial expenses of marriage and so the money was not a debt. And he said that he have been forced by police to lend the cheque to me. 

Actually I have sent the money to him after getting a loan from hdfc bank on my name. I have transferred 15 lakh of money to his account on the month of feb 2022 through online. He started paying the EMI back to my account each month through online with the transaction comment as EMI till 2023 of Jan . The EMI was paid from his business account and his wife's personal account and his mother's personal account with the transaction comment as EMI. Here it's proven that he received the amount as a debt. And my marriage was happening during the month of November 2022. After my marriage he stopped paying the EMI. Their parents convinced me that he will repay soon. He didn't pains the emi back till the end of 2023. Then he gave me two post dated  cheques and bounced it. Now pls let me know if there is any chance that he will be escaping from this case. How can I proceed further to get the money back ?

The query is rather imaginary. In a criminal case, it is for the complainant to lead evidence and prove his case. The Court would question him only after the complainant's evidence is completed.

The cheque issued by the accused itself is an evidence besides the repayment through EMI is another substantial evidence to prove the legally liable debt.

You continue to follow up with your advocate properly and await court decision.
