cheque no. entered wrong

a banker has entered wrong chqeue no while entering in a clearing system and the cheque got passed. After 7 days customer given stoppayment request for that chqeue, the banker accepted cheque stoppayment request and enter in a system. the system accepted the stoppayment, but the cheque has already passed with a wrong cheque number. in the issue banker is liable to pay that amout

customer is safe.  It is the mistake of the banker , he is liable .

Definitely banker has committed deficiency in service hence he is liable to pay.

but the banker is says that cheque has been passed before customer request, our mistake is to accept the stoppayment after passing the chqeue becouse we have committed that with wrong cheque no.. so we are liable to pay only stoppayment charges.
