Child custody

I am an NRI whose child was taken without permission to India. Kid is only 2 years old and I want to fight for custody. GWA requires 5 years age I think. How can I fight for my child and keep the custody proceedings going for 3 more years? I am very concerned the child is growing up in a bad environment.

 You  can  take urgent  action  for  custody  of  child  notwithstanding  any time limit , provided  you   justify  taking  action   for  custody , 5 years time   { up to age of the  child} is ordinarily  so  because  the child of tender age  reqires  mothers  care  but it is  not iflexible  rule

I agree with Mr Pandya and you can seek and secure custody of the child even at this age, if you can prove your case.

Is the child Indian Citizen>

 

There can be various approaches to this and the decision again can be diverse.
