CHOCOLATE JUDGE - FANTASTIC

Believe or not, what you read below is true and has happened in a court in Kolkata few days before.

 

A judge has revealed his expression of love for a small child by getting her chocolates and also deciding the case in the favour and desire of the child.

 

Kolkata:  A judge named Mukopadhaya was hearing a case of custody of a female child named parbi aged 10 years.  The child had so far been in the custody of the mother before the case was filed before the court.  The judge Mukhopadhaya was listening to the case and suddenly asked the child in open court about her willingness to live with father named Rana or mother named Anamika.  The girl child immediately replied that she wanted to live with her father.  This was opposed by the mother in the open court that the child was under pressure of the father.  Suddenly to everyone’s surprise the judge stepped down from his chair and came down towards the child and took her out to a shop and got her chocolates.  In the shop the judge spoke to the child in a friendly manner asking her about her education, school, friends and names of friends, hobbies etc, etc to create belief and confidence in the mind of child.  This was done by the judge to ascertain and understand the true feelings and wants of the child.  Then he brought the child to the court and asked the child her willingness to go with the mother or father.  The child replied that that mother has been harassing her and she never cared for her and has been busy chatting with her friends only.  The child also expressed her desire to be with her father. 

 

Satisfied with this, the judge wrote the judgment giving the custody of the child to the father. 

 

I don’t think a better enquiry than this is necessary to decide the issue of custody of a child.

 

What a great judge he is?

This shows that the judge cares about the welfare of the child and has actually gone to such a level to understand the child psycology on why she is asking for the same. If the judge takes an extra efforts to understand the childs mindset before taking the custodial decisions, then this would have been very fruitful.

Very nice and good step for the welfare of child, coz some times children r under depression, so cannot make accurate statement but if they feel it comfertable with judges then they can speak like friends and can express their feelings freely.

Wonderful.... Appreciated and the other Judges has to follow this and understand the mindset of the child and her willingness. I really amazed and feels gud for the child.

All was done by the judge having regard to the Chair he is holding and responsibilities and respect attached to the chair of judge. The most important function of Judge is to deliver the justice in the practical manner. Such judge should be appreciated by all the members of Lawyersclub.

Such judges are real judges who know how to deliver justice even beyond  the legal books

Thats really incredible ... Hats off to the judge... but in how many cases does this happen??? there is so much of injustice happening and the people who are really suffering are going into depression and loosing their valuable lives due unnecessary delays and adjournments

Wide publicity Yes. It deserves our attention. The electronic media that feeds on film stars won't touch it with a barge pole.

Secondly, the lower magistracy will laugh it away as a gimmick. Do you think they read SC/HC judgements?
