I;m in Hyd. Any legal advice on this matter would be great. So the property is an old agricultural well bought in 67, the original layout from 66 showed the well to be clearly demarcated on the layout created when the land owner who we bought from plotted the land. He had the land segregated into plots. We bought many plots but also the well that is close to 1200 sqy also was purchased, we have clear title, received a Revenue NOC over the well recently. The city 's claim is since it is located in land that is shown to be in designated OPEN SPACE vested to the city, they designated as a park in a newer layout and took possesion recently on that regard. They constucted a wall and put a board recently, but unofficially are claiming it from the time of the second layout. I am speaking to them to say for one, if a stucture falls in Open space, and we have title to that "structure" we own the land. Also the second layout that designates the land as a park because the one that proceeds it (the one at the time of purchase) states it is a well. It remains to be a well that is not functional today.
Will this need to go to court or can I manage it through a high level city official to favor our position??
