Civil

A company is registered in the state of Gujrat. The company has signed a contract with a firm registered in Pune to supply some material where it is specifically mention that if any disputes arises, it will be "SUBJECT TO PUNE JURISDICTION" and the both the companies agreed on it and signed the contract in pune.

Now, the company from gujrat has supplied some vague material and the pune company has complained it to them and stoppeed the payment.

The company from Gujrat has filed a petition in the Civil court of Ahmedabad, where the company is registered.

My question is If it is specifically mentioned in the contract about "SUBJECT TO PUNE JURISDICTION" , then how can the plaintiff file a suit in Ahmedabad.

Second the cause of action is pune nad deefendent resides in pune.

I want a case law on it in favour of Defendant.

Dear Sir,

I have given power to sell my land to my own brother. He agreed  that he include me also with the sale agreement if he sells to any body. I and my brother did not sigh any agreement between us.

He sold the land without informing me and now willing to settle less amount to me than the amount sold by him. Kindly advise me in this regard how to proceed with legal suits.

Regards

Sadakka
