Civil suit partition co owners

Hi

My brother has filed a civil suit against me and other co owners of an ancestral property. We had actually partitioned the land earlier and are in separate possessions of our shares but now my brother is backing out and has filed a civil suit. In the civil suit while describing the history of the property he has mentioned that our father is not alive anymore however the fact is that our father is alive. What can we do in this case. isn't the suit faulty as false information is furnished. Can we take criminal action against the plaintiff for furnishing false information in court. Plz suggest the best course of action available.

Yes. This is a petition based on false and frivolous submissions.

Your father himself can attend the court and disprove the said submission. The petition is eligible to be dismissed on the thresold itself.

Once it is disproved, you can initiate criminal proceedings against him.
