Claiming to be non hindu and 498a dv

An Australian citizen whose parents are Hindu living in India gets married with a Hindu girl as per Hindu ceremony.The marriage is not registered.

Now the girl and her family threatens the man with 498a and DV to extort money.Th man is born Hindu but he does not believe in Hinduism and in Australia one can have no religion.In this case can he claim that he does not believe in Hinduism and not a Hindu and he also quit the Indian nationality long time before because he does not believe in Hinduism.

In Australian official records his religion is mentioned as None.In this case is the ceremonial marriage between a Non Hindu and Hindu valid and does any HMA apply in this case?

He is a hindu for all legal purpose....Sec 2 HMA...Belief is not relevant...
