Dear Sir,
My unmarried sister died intestate. A Primary Teacher's cooperative society has paid a fixed deposit amount of Rs 10 lacs to the nominee inspite of letters of objection raised to them by other heirs. The very first objection was delivered by hand to one of the office bearer. The society did not reply to any of my letters but entertained the demand of the nominee and paid him. They did not even called for any meeting.I wish to know the following:
1) I raised a complaint to the Asst. Registrar against this. What sections os the MCS act can I use for this case to make my points strong?
2) Can the Asst. Registrar guide the office bearers to retrieve the sum from the nominee and keep it till the succession certificate is received?
3) If sr no. 2 is not possible, then what is the next option? Co-op court / Civil court?
Regards
Anil
