Co operative society open parking issue

Hi,

I am resident of a co-operative society in Pune Viman nagar. Many of us use open parking space since we have no covered parking for us.

Since begining, society was charging Rs 500 per month (6000 Anuual) one time year charges. However from last year they have increased it to 1000 Rs per month and demanding one time per annum i.e 12000.

This is very frustrating and kind of harassment for us.Why they need to charge for open space. And if they are authorised but how much and for how long.

Please help on this. Whom to contact.

1.  Parking Charges are covered under  'service charges".  Service Charges have to be charged on monthly basis, which covers Parking Charges


2.  Make a written complaint to the local ward registrar of cooperatives, regarding this forced collection and seek restraining directions /orders from him to the society.

please also see the constitution of the society. Generally office bearers do not share this constitution with members as they see dilution of the feudality. get a copy from registrar office either by applying or under RTI as appropriate as per local convenience.

How many members are there in your Society?  How many of the members have cars being parked in the open space and are paying parking fees. The Model byelaws have provision to charge parking fees. No upper limit has been prescribed. The parking fees have to be approved by the General Body. Generally those members who cannot afford a car are hostile towards those who have cars. Hence if the former are in majority any resolution to raise the parking charges will get passed. The proposal to levy or revise the parking fees should be in the agenda of the General Meeting and should also appear in the notice calling the meeting. The amount also should be mentioned. The resolution should not pass an amount which more than what is mentioned in the notice.

If any of the above is not satisfied you can make a complaint to the Registrar.
