Coconut falling on public road from nearby residental plot.

One cocnut tree is standing to public road from nearby residental plot and falling coconuts endanger the life and safety of people. Even after repeated requests the owner is not ready to cut it. So, please let me know what legal action can be taken against the plot owner? Last week one car also got damaged by falling cocnut on top of it. So, can we approach any authority to get compensation in such cases in future?

In order to cut a coconut tree or any tree, for that matter, permission of competent authority is required in most places. If not the person who cut it can be prosecuted. Permission is hard to come by. If the tree is healthy and the coconuts are plucked every 40 days, chances of one falling are very remote. In places like Kerala, it is difficult for one to stand somewhere, with no coconuts above. Still people live a lifetime without any coconut falling on their heads.
