Collecting evidence: catch 22 situation

Dear Learned Friends,

Often in DIVORCE / MAINTENANCE cases, many learned friends have suggested that the aggrieved party should collect maximum evidence to support her/his case. One of the ways to collect evidence against your erring spouse is to access her/his email. 

If that is true then does the law of invading privacy of an individual does not apply here? If yes then how to deal with this CATCH-22 situation.

I never suggest hacking as a tool of self defense. Never do that.  There are many other legal ways to get case in your favour.

if you hack her account, do it smartly.. go to an internet cafe far away from your residence and do it.. otherwise dont..

i recently got an FIR registered since my wife got my income tax account hacked through a chartered accountant.. in the investigation report, it has come that the CA's email id was used and the IP address points to his office..
