Conditional Sale Deed

Hi,

 

  I am planning to buy a property, which has the following history

 

  1.  A Society has allocated the plot to  Mr.First_allotee in 1978, through a procession certificate

 

   2. Later in 1982, the society transferred the plot to Mr.First_allotee through a SALE DEED, with Condition that plot cannot be sold for  5 years

 

   3.  However Mr.First_allotee  sold the plot to  Mr.Second_person in 1984, which is not meeting the condition of sale

 

   4. Now Mr.Second_person is no more and his legal successors are willing to sale the plot

 

   5. Recently they have got a NoC from the society (which is on a letterhead, signed by Secretary of the society).

 

Please let me know if it si fine to go ahead and buy the property.

After obtaining such NOC nothing will be against you to purchase the property

Just now, called up teh president, he confirmed that the letter has been issued through him only. However I am not sure, whether they maintain any records for those letters. The president of the society claimed yes, but was not willing to go in details.
