Conversion of parking garage into society office

Dear Experts, We have a newly formed society by builder and during handover process of society the committee members asked builder to provide the parking garage which builder was using as his office but builder proposed the society that he will partition the garage in 2 parts and half parts will be used by society as it's office and half would be used by builder as his office. Now since builder is converting garage into office and we have a civil and criminal case pending against builder, can we file FIR on builder and committe members for this unlawful act.
