Minor guardian

Dear Learned Friends,

Here is my question:

A is minor, whos parents passed away, except his uncle no one is to look after him.  His uncle sold the properties of A without obtaining the permission from the Civil Court, but he has deposited the entire sale proceeds in the name of A in Bank.

Now A's uncle wants to file a petition to get appoint himself as minor guardian of A disclosing the true facts before the court.

Can he filed a petition?

there will be question if any other party coming opp. to uncle  about to  be gardian and work done before appointing gardian by uncle

I agree with you.  But  the sale made by the  uncle it self is illegal..
