Ipc 498a has lowest conviction rate

As per latest statistics from National Crimes records bureau for year 2009. Section 498a has second lowest conviction rate in india compared to other criminal section. The only other section under which there was lower conviction was arson (IPC 435, 436 and 438) and that too beat 498a by mere 0.3%

Here is hard statistics for year 2009

1. Conviction rate under 498a ( across India) 19.8%

2. Conviction rate under arson ( IPC 435, 436, 438) 19.5 %

3. Highest criminal conviction rate( other Criminal IPC) 53.6 %

Data hides more than reveals. This data is for the cases decided in 2009 only. And doesnot include cases compounded/ withdrawn/ qaush.

The rate of conviction remains less than 2% if we take all of these in account.

Yes it is for cases decided in 2009 only.

I too think that this statisctics is best case and does not represent true picture. To get a true picture one will have to

1. also include in the base those cases that are compounded or withdrawn.

2. also take out those cases that resulted in conviction by lower court but latter are set aside by higher courts.

When feminist were confroted with low conviction rate previously - they use to put defence -- "so what conviction rates in other IPC is also very less."

This statistics takes air out of their defence -- the conviction rate in the 498A is not just low, it is LOWEST.
