In a Judgment regarding non payment of GRATUITY to a retired professor of AMU, the Apex court ordered compensation for delay by 3 years, that amounted to about 35% PA interest on the payable amount, while generally it is seen that an interest not higher than 12% is allowed, and recently, in a case, it was as low as 8% only. The court pleaaded that the gratuity amount, if invested in SHARE market, could have fetched enormous profit.
It is also seen that while listing cases even in higher courts, it appears as if no RULES exist to be followed, with the result that while some cases are decided early and some keep lingering. Reason is obvious.
Judgments, very often vary to such an extent that one is constrained to conclude a partisan attitude. If the court in case of a WP for payment of retirment dues, allows an amendment after 3 years, while in other in 3 weeks, it is definitely an aberration, which needs attention.
