Over 35,000 cases to be transferred to Mumbai City Civil Court Tuesday, April 17, 2012 By Prashant Hamine The Legislative Council on Monday passed the Mumbai City Civil Court (Amendment) Bill 2012, that seeks to transfer around 35,000 cases out of the total 45,000 pending cases, of the value up to Rs.1 crore pending before the High Court, to the Mumbai City Civil Court. Piloting the bill for passage, Minister of State for Law and Judiciary Bhaskar Jadhav disclosed that, as of today, a total of 23,825 cases are pending before the Mumbai City Civil Court. Out of these pending cases, 15,214 are civil cases and 8,611 are criminal cases. The minister clarified that the legislation was restricted only for the city of Mumbai. Way back in 1862, these city civil courts were created by the British in the port cities of Mumbai, Madras and Kolkata. In 1947-48, these courts had the powers to hear cases of the value up to Rs.10,000, which was amended in 1977 and the ceiling was raised to Rs.50,000. The government, in 1987, decided to remove the financial cap on the value of the cases, which was challenged by one Jamshed Guzdar. The ceiling then was raised from Rs.1 lakh to Rs.5 lakh, and later on to Rs.10 lakh. Responding to issues raised by members, Jadhav stated that out of the 87 posts in the Mumbai City Civil Court, 64 posts have been filled, while the rest are being filled through the MPSC. Speaking about improving the infrastructure, he said that both the state and centre have allocated Rs.262 crore. On the issue of Money Lending Act, he stated that the act is pending for presidential assent before the central govt.
