Appropriate time to file divorce

RCR is under process for the last 2 yrs and to counter that smt. filed false 498a which is also under trial. earlier she was pleading that she wants to come back resume the relationship but nothing proceeds in that.

Now I want to file divorce on crulelty ground as she had filed false case against me other then that there are various other reasons like dessertion/defamation/....

filing divorce will not go against me in my 498a trial

Your valuable suggestions are required

regds.

RCR is a fruitless remedy. I don't advise that to anyone. You can withdraw RCR and file for Divorce. RCR and Divorce cannot go together as both are mutually destructive remedies. 498A is a criminal case, which will operate in its own field with full vigour without being trammelled by a divorce suit.
