Can the police enter the office of a businessman and take away the books and documents from his offaice, without either making a Panchnama and merely on pin pointing the documents by the complainant? In this particular case, the suit is filed as a private case and not a police case. What will be the recourse if the accused has informed the court of this happening and has also written to the Supt of Police and also the concerned police station. And further can a clerical staff of the police station (usually call the writer) can conduct the said search and take away the said documents?
