negotiable instruments act when notice returned unserved to accused what will be limitation period for filling a complaint?

Limitation start from the date of issue of notice to opposite party. whether it is served or not is not issue. You have to follow the NIAct procedure to file the complaint. Giving of notice or taking of notice is explained in Supreme Court Judgment. Period of one month for filing complaint from date immediately following the date on which period of 15 days from date of receipt of notice by drawee expired. Even when notice is returned you are suppose to file complaint within in one month. If you want I will provide Judgment

Notice sent on last known address deemed service of the notice. The limitation will be same as provided in NI Act.
