Settlement deed and sale deed

Elder brother has transferred his land to the name of younger brother through settlement deed a year ago. Now while looking for further sale, the authorities say that if a property is transferred through settlement deed then the property comes into ceiling. That is, the property holder (both transferor and transferee) lose their right to sell construct or alter the property. They merely have the right to use the property. Is this true? If so what is the solution. They also said that this has been implemented since 2008 and this should have been made through sale deed. The transferor was not aware of this at the time of transfer. Now the property is just being used. Pls help.
