investigation without FIR

A, is trackless for the last four days.police doubts that either He has been murdered or kidnapped .but there is no FIR in this regard. can the police start the investigation without an FIR. ? reasons for supporting your answer

Hello Karunakar Bunga,

In a case where the police suspects happening of a cognizable offence it can start investigation without an FIR. Police have the statutory right to investigate and it cannot be taken away by the judiciary.

Although when the police discovers any material inputs regarding the cognizable offence, filing of an FIR becomes important as it sets the motion to criminal justice.
